Terms and Conditions for the event: EK runs – Shaping the future

By registering for or donating to EK runs – Shaping the future (the "Event"), you agree to the following terms. These terms constitute a legally binding agreement between you and the fundraiser run ("we," "us," or "our").
1. Registration & Eligibility

Participant Health: You certify that you are physically fit and have not been advised otherwise by a qualified medical professional.

Minors: Participants under 18 must have these terms agreed to by a parent or legal guardian.

Accuracy: You agree to provide accurate information during registration as required by the Michigan Persons with Disabilities Civil Rights Act and other state regulations.
2. Non-Refundable Policy

No Refunds: All registration fees and donations are final and non-refundable. This applies regardless of your ability to participate, including but not limited to injury, illness, or personal schedule changes.

Event Cancellation: In the event of extreme weather, public health mandates, or other "Acts of God" in Michigan and South Carolina, we reserve the right to cancel or transition the Event to a virtual format. Because funds are committed to event overhead and charitable causes in advance, no refunds will be issued in these circumstances.
3. Third-Party Payments

Payment Processing: All payments are processed through a secure third-party provider (e.g., Wix Payments, Stripe, or PayPal).

Merchant of Record: While this website facilitates the transaction, the third-party processor handles your sensitive financial data. By paying, you also agree to the Wix Payments Terms of Service or the terms of the applicable processor.

Liability: We are not responsible for any errors, unauthorized charges, or technical failures caused by the third-party payment system.
4. T-Shirt Incentive

Availability: Starting T-shirts are provided as an incentive for specific donation levels or registration types. These are available while supplies last.

Sizing: We cannot guarantee specific size availability. Sizes are fulfilled on a first-come, first-served basis at the time of check-in/pickup.

Tax Deductibility: Under IRS rules, the portion of your payment covering the "fair market value" of the T-shirt and event participation is generally not tax-deductible. Only amounts paid in excess of this value may be considered a charitable contribution.
5. Liability Waiver & Release
A
INDEMNIFICATION, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
This Indemnification, Release, and Assumption of Risk Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in connection with participation in the Fundraising Run and related activities (the “Event”) conducted at the Greenville-Pickens Speedway or "LOCATION MICHIGAN" premises (the “Property”).
1. Assumption of Risk
Participant acknowledges that participation in the Event involves inherent and significant risks, including but not limited to personal injury, permanent disability, death, property damage, weather conditions, track surface conditions, vehicle or equipment hazards, and actions of other participants or spectators. Participant voluntarily and knowingly assumes all such risks, whether known or unknown.
2. Release of Liability
Participant hereby fully releases and forever discharges the owner of the Property, the event organizer, its members, managers, officers, employees, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, liabilities, costs, or causes of action, whether arising in contract, tort, negligence, premises liability, or otherwise, including claims arising from the sole or concurrent negligence of the Released Parties, to the fullest extent permitted by law.
3. Indemnification and Hold Harmless
Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, lawsuits, damages, judgments, costs, and expenses (including attorneys’ fees) arising out of or related to:

Participant’s presence on or use of the Property;

Participant’s participation in the Event; or
-
Any injury, death, or property damage caused by or attributed to Participant,
even if such claims are caused in whole or in part by the negligence of the Released Parties, to the fullest extent permitted by law.
4. Medical Treatment
Participant consents to receive medical treatment in the event of injury and agrees that the Released Parties have no responsibility for medical care or related costs.
5. Insurance
Participant acknowledges that the Released Parties do not provide insurance coverage for Participant and that Participant is solely responsible for obtaining any desired coverage.
6. Governing Law and Venue
This Agreement shall be governed by and construed under the laws of the State of South Carolina and State of Michigan, and any legal action shall be brought exclusively in a court of competent jurisdiction located in South Carolina and Michigan, depending on the location of the fundraising run.
7. Severability
If any portion of this Agreement is found unenforceable, the remaining provisions shall continue in full force and effect.
8. Binding Effect
This Agreement is binding upon Participant and Participant’s heirs, executors, administrators, and assigns.
PARTICIPANT ACKNOWLEDGMENT
By signing up for the event, Participant acknowledges that they have read, understand, and voluntarily agree to this Agreement, and understand that they are giving up substantial legal rights, including the right to sue.
B. The Mandatory Physical Liability Waiver Form
This liability waiver will be printed and required to be signed by all participants before the event starts.
6. Media Consent
By participating, you grant us permission to use any photographs, videos, or recordings taken during the Event for promotional and fundraising purposes on our website, social media, as well as the Website of the Children’s Foundation of Michigan.
7. Governing Law
These terms are governed by the laws of the State of Michigan and State of South Carolina. Any disputes arising from these terms shall be resolved in the courts located in Wayne County Michigan and Pickens County South Carolina.
